These Terms explain the rules for using the ItemShare mobile app, website, and related services (together, “ItemShare” or the “Platform”). The Platform is operated by ItemShare LLC (“we,” “us,” or “our”).
By creating an account, joining the waitlist, or using ItemShare, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use ItemShare.
The most important point: ItemShare simply helps neighbors find each other and communicate about borrowing and lending household items. ItemShare does not own, inspect, test, deliver, insure, or guarantee any item or user. Lending and borrowing are directly between users and are done at their own risk.
1. Who May Use ItemShare
You must be at least 18 years old and legally able to agree to these Terms.
You must provide accurate account information and may not pretend to be another person, create an account for someone else without permission, or use ItemShare for an illegal purpose.
If you join the waitlist, you authorize ItemShare to send launch, early-access, and related ItemShare updates to the email address you provide. You can unsubscribe at any time.
2. How ItemShare Works
A user can post a request for an item. Another user can offer to lend the requested item. Users can then message each other and decide whether, when, and where to exchange and return the item.
ItemShare provides the technology that allows this connection. ItemShare is not part of the lending agreement between the users and does not decide the condition, value, permitted use, pickup arrangements, return deadline, or responsibility for an item.
Users are responsible for communicating clearly and agreeing on the important details before an item is handed over.
3. Items and User Interactions Are at Your Own Risk
ItemShare is not responsible for an item that is lost, stolen, damaged, destroyed, misused, returned late, or not returned. ItemShare will not reimburse, repair, or replace an item and will not pay either user for an item-related loss.
ItemShare is also not responsible for:
- the condition, quality, cleanliness, safety, legality, ownership, value, or usefulness of an item;
- inaccurate item descriptions, photographs, profiles, ratings, or messages;
- injuries, illness, property damage, or other harm caused by an item or its use;
- theft, fraud, harassment, threats, or other conduct by a user;
- disagreements between a Borrower and Lender; or
- anything that happens during a meeting, pickup, use, storage, or return.
ItemShare may verify that a user controls a phone number or email address. That does not mean ItemShare has confirmed the user’s identity, address, background, honesty, qualifications, or ability to use an item safely. ItemShare does not perform background checks unless we clearly state otherwise.
To the extent the law allows, you agree not to hold ItemShare LLC or the people working on its behalf responsible for a loss or claim caused by another user, an item, a lending arrangement, or an in-person interaction. This does not remove any responsibility that the law does not allow ItemShare to exclude.
4. Responsibilities of Lenders
If you offer or lend an item, you are responsible for making sure that:
- you own the item or otherwise have permission to lend it;
- your description and photographs are accurate;
- you disclose known damage, defects, missing parts, hazards, or special instructions;
- the item is not stolen, recalled, illegal, counterfeit, or prohibited by these Terms; and
- you decide whether you are comfortable lending it to the Borrower.
You should photograph the item and its condition before handing it over. You should also provide any instructions or safety information needed for normal use.
By lending an item, you accept the possibility that it could be damaged, lost, stolen, misused, or not returned. Any request for payment, repair, replacement, or other resolution must be handled directly with the Borrower. ItemShare may provide reporting tools but is not required to decide fault, value an item, collect money, or resolve the dispute.
5. Responsibilities of Borrowers
If you borrow an item, you are responsible for:
- inspecting it before accepting or using it;
- using it only for its normal intended purpose;
- following instructions and warnings;
- having the experience, physical ability, licenses, supervision, and safety equipment needed to use it;
- keeping it reasonably secure and protected from theft, weather, and avoidable damage;
- not selling, changing, repairing, disassembling, or lending it to someone else without the Lender’s permission;
- promptly telling the Lender about damage, loss, malfunction, or an accident; and
- returning it at the agreed time and in substantially the same condition, except for normal wear from the agreed use.
Do not accept or use an item that appears unsafe, broken, recalled, unsuitable, or different from its description.
You may be responsible directly to the Lender if you lose, damage, misuse, or fail to return an item. ItemShare does not determine what happened and does not collect or guarantee payment.
6. Safety
Use reasonable judgment whenever you interact with another user. You are never required to enter someone’s home or allow someone into yours. Choose a pickup location where you feel comfortable, protect your personal information, and stop an interaction if something feels unsafe.
ItemShare is not an emergency service. If someone is in immediate danger or a crime may be occurring, contact 911 or the appropriate local authority.
You can report unsafe conduct, suspicious activity, prohibited items, or violations through the Platform or by contacting support@itemshareapp.com. We may review reports, remove content, restrict accounts, preserve relevant information, or contact authorities when appropriate, but we cannot guarantee that we will detect or prevent every problem.
7. Prohibited Items and Conduct
Do not request, offer, lend, or borrow anything that is illegal, stolen, counterfeit, recalled, clearly unsafe, or that you do not have the right to possess or share.
Prohibited items include firearms, ammunition, explosives, fireworks, illegal drugs, controlled substances, prescription-only products, alcohol, tobacco or vaping products, hazardous materials, motor vehicles, stolen property, government identification, financial accounts or payment cards, and anything whose transfer would require a license or regulated procedure that the users do not satisfy.
Do not use ItemShare to threaten, harass, stalk, discriminate, defraud, exploit, injure, or invade another person’s privacy. You also may not create fake accounts, manipulate ratings, send spam, distribute malicious software, scrape user information, interfere with the Platform, or use information from ItemShare for unrelated surveillance or commercial solicitation.
8. Accounts, Messages, and User Content
You are responsible for your account, password, and activity. Tell us promptly if you believe someone else accessed your account.
You keep ownership of the photographs, descriptions, messages, reviews, and other content you submit. You give ItemShare permission to store, display, format, and use that content as needed to operate and improve the Platform, show it to the users you intended, address safety or support issues, and enforce these Terms.
Do not post content that is illegal, deceptive, threatening, discriminatory, sexually exploitative, invasive of privacy, or that violates another person’s intellectual-property rights.
Profiles, requests, offers, item photographs, ratings, and reviews may be visible to other users. Messages are visible to their participants. ItemShare may review content or messages when reasonably needed for support, safety, fraud prevention, legal compliance, or enforcement.
9. No Payments, Deposits, Insurance, or Item Protection
ItemShare does not charge users to borrow or lend items and does not process rental payments, security deposits, or compensation between users.
ItemShare does not provide insurance or an item-protection plan. Users are responsible for determining whether their own renters, homeowners, personal-property, liability, health, or other insurance might apply. ItemShare does not promise that any insurance will cover a loan made through the Platform.
If users voluntarily agree that one user will pay another for damage or loss, that arrangement is entirely between them. ItemShare does not collect, guarantee, or enforce the payment.
10. Availability and Account Actions
We work to keep ItemShare available and useful, but we cannot promise that it will always be uninterrupted, secure, or error-free. Features may change, and the Platform may occasionally be unavailable.
We may remove content or restrict, suspend, or close an account when we reasonably believe it is necessary for safety, security, fraud prevention, legal compliance, or enforcement of these Terms. You may stop using ItemShare or request deletion of your account at any time.
11. ItemShare’s Name and Technology
ItemShare’s software, design, name, logo, graphics, and other Platform materials belong to ItemShare LLC or its licensors. You may use the Platform for its intended personal purpose, but you may not copy, sell, reverse engineer, or commercially exploit it without permission.
12. Changes to These Terms
We may update these Terms as ItemShare changes. We will post the updated version and change the “Last updated” date. If a change is important, we will provide additional notice or ask users to agree again where appropriate.
13. New York Law
These Terms are governed by New York law, except where the law of a user’s home state must apply. These Terms do not take away rights that cannot legally be waived.
